1. Acceptance of These Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Cresco mobile application, website, and related services (collectively, the “Service”). By downloading, accessing, creating an account for, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using Cresco, you represent that you meet this minimum age requirement and that you have the legal capacity to agree to these Terms.

If applicable law in your jurisdiction requires additional consent or authorization for your use of the Service, you are responsible for obtaining it.

3. Account Registration & Security

An account is required to use Cresco. When creating or maintaining an account, you agree to provide information that is accurate and reasonably current.

• Name or display name
• Email address
• Date of birth
• Sport
• Reason for using the App

4. Purpose of the Service

Cresco is a digital tool designed to help users track habits, routines, goals, and performance-related information. The Service may also include social features that allow users to create and join private groups and compare limited performance-related information.

5. Free Access

Cresco is currently provided free of charge and does not include paid subscriptions or paid features at this time.

If we introduce paid products, subscriptions, or other charges in the future, we may update these Terms and provide any disclosures or contractual information required by applicable law before charging users.

6. Groups Feature

Cresco allows users to create and join private groups. Groups are intended to support accountability and comparison among invited users.

By using Groups, you agree to the following:

• Groups may have a name and an optional description selected by the group creator
• Groups are joined through a unique invite code or invite link; Cresco does not provide a public directory or public search of groups
• When you join a group, your display name, sport, streak count, Total Score average used for group rankings, and the date you joined the group are visible to members of that group
• Detailed sleep data, recovery data, nutrition data, individual training inputs, email address, and date of birth are not made visible to other group members through the Groups feature
• The group owner may manage the group and may remove members from the group
• You are responsible for the accuracy and appropriateness of any group name or description you create
• You must not create or use group names, descriptions, or display names that violate these Terms or applicable law
• You must not use invite codes or invite links in a way intended to abuse, disrupt, or circumvent the private nature or security of Groups
• Cresco may remove, restrict, or disable a group that violates these Terms or creates a security, legal, or safety concern

7. Community Rules

All users must use Cresco respectfully and lawfully. These standards apply to display names, group names, group descriptions, invitations, and other user-controlled information or conduct associated with the Service.

8. Acceptable Use

In addition to the Community Rules, you agree not to:

• Use the Service in violation of applicable law or regulation
• Attempt to gain unauthorized access to accounts, systems, databases, or data
• Interfere with, overload, disrupt, or impair the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract source code except to the extent such restriction is prohibited by applicable law
• Upload, transmit, introduce, or distribute malicious code or harmful technical content
• Attempt to bypass authentication, authorization, security controls, rate limits, or other protective measures
• Scrape, harvest, collect, or access other users’ information without authorization
• Use automated systems in a manner that materially interferes with the Service
• Use Cresco to infringe the intellectual property, privacy, publicity, or other rights of another person

9. Data Storage & Privacy

Your use of Cresco involves the processing and storage of account information, user-provided tracking data, group information, and certain technical information.

Our collection, use, disclosure, retention, and protection of personal information are described in the Cresco Privacy Policy.

10. Third-Party Services

Cresco relies on third-party services to provide parts of the Service. These may include:

• Supabase — backend infrastructure, database, and authentication-related services
• Google services — authentication, platform, technical, or other services used by Cresco
• Apple services — authentication and platform services
• Facebook / Meta services — login or related integrations used by Cresco
• Resend — delivery of certain Cresco emails and website contact messages

11. Intellectual Property

Except for content or information owned by users or third parties, the Service and its software, design, branding, logos, interfaces, text, graphics, and other Cresco materials are owned by Cresco or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, Cresco grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose.

You may not copy, reproduce, distribute, sell, license, modify, create derivative works from, or commercially exploit Cresco materials except with permission or where applicable law expressly permits it.

12. Availability, Changes & Updates

We may maintain, update, modify, add, remove, or discontinue features or portions of the Service in order to improve functionality, security, reliability, or the user experience.

We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device or operating system.

Where applicable law requires notice, consent, or other steps before a change takes effect, Cresco will comply with those requirements.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis. Cresco does not guarantee that tracking data, calculations, scores, reports, recommendations, or other outputs will be complete, error-free, or suitable for a particular personal objective.

Nothing in these Terms excludes or limits any warranty, guarantee, or right that cannot lawfully be excluded or limited under applicable consumer protection or other mandatory law.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Cresco will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of or inability to use the Service, including loss of data, productivity, opportunity, or damages arising from interactions between users.

Any limitation or exclusion in these Terms applies only to the extent permitted by law. Nothing in these Terms limits liability or legal remedies where limitation or exclusion is prohibited by applicable law, including mandatory consumer protection rights.

15. Suspension & Termination

You may stop using Cresco at any time and may delete your account through the App where that functionality is available.

Cresco may restrict, suspend, or terminate access where reasonably necessary, including where:

• You materially violate these Terms or the Community Rules
• We are required to do so by law or a valid legal process
• Your use presents a security, fraud, abuse, or safety risk
• Action is reasonably necessary to protect other users or the integrity of the Service

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, our practices, or applicable requirements.

If a change is material, we may provide notice through the App, website, email, or another appropriate method. Where applicable law requires your express agreement to a change, we will request it.

The effective date displayed at the top of this page indicates when these Terms were last updated.

17. Governing Law

These Terms are governed by the laws of Québec and the federal laws of Canada applicable in Québec, without limiting any mandatory rights you may have under the laws that apply to you.

To the extent permitted by applicable law, disputes relating to these Terms or the Service will be brought before courts of competent jurisdiction in Québec. If mandatory consumer protection or other law gives you the right to bring a dispute in another jurisdiction or forum, that right is not waived by these Terms.
